Is Red 40 bad for you? What the rules actually say

Red 40 is Allura Red AC (E129), a synthetic red dye that the FDA continues to list as a certified colour additive for food. The rules naming it are written elsewhere: the EU requires a labelling statement on products that contain it, and California bars it from public schools from 31 December 2027.

This page sets out what the dye is, what job it does, every name it hides behind on a label, and exactly which regulator has decided exactly what. It does not answer the headline question with a verdict, because no regulator has issued one, and a site without medical credentials inventing one would be the least useful thing on this page.

What Red 40 is

Red 40 is the American common name for Allura Red AC, a synthetic azo dye numbered E129 in Europe and made from petroleum-derived intermediates. It dissolves in water, holds its shade in acidic drinks and under shop lighting, and belongs to the group of US colour additives whose batches are certified before use.

Certification is a procedural fact worth understanding, because it is the thing people mean when they say the FDA “approves” a dye. Each manufactured batch is submitted for analysis against a published specification before it may be sold for food use. That is a purity check on a batch, not a fresh review of the colourant every time.

The same molecule reaches labels in two physical forms. The water-soluble dye is what colours a drink; Red 40 Lake is the same colourant precipitated onto an aluminium substrate so that it disperses through fat and coats a surface instead of dissolving. A sweet can carry both, and the label may print both.

What Red 40 does in a product

Red 40 exists in a formula for one reason — colour that survives the product’s life. Natural red pigments from beet, berry or cochineal shift under heat, acid and light, and they cost more per unit of colour. A synthetic azo dye gives a manufacturer the same shade in every batch for years.

Colour that holds

Beet and berry pigments brown or fade under heat, acid and shop lighting. Allura Red AC keeps its shade through pasteurisation, low pH and months on a shelf, which is why it dominates drinks and sweets.

Colour that signals flavour

Red reads as cherry, strawberry or fruit punch before anything is tasted. The dye is doing marketing work as much as decorative work, and that is why it survives every reformulation round.

Cost and consistency

A few parts per million of a synthetic dye replace a much larger quantity of plant concentrate, and every batch matches the last one. Reformulating away from it changes both the price and the look.

Where it appears is broader than the sweets aisle. Sports and soft drinks, gelatin desserts, frostings, flavoured yoghurt and dairy drinks, breakfast cereals, snack crackers and some baked goods all use it, and so do products outside food entirely — medicines, chewable supplements and pet food carry it under the same or a closely related name.

The names Red 40 goes by on a label

Red 40 is declared under at least five different names depending on the market, the product format and the manufacturer’s house style. Recognising all of them matters more than any single fact on this page, because a shopper scanning for two words will walk past the other three.

A generic line reading “colour added” or “artificial colour” without a name tells you a colourant is present and nothing about which one. That declaration style is common on imported packaging, and it is the point at which reading the label stops working and the manufacturer has to be asked.

What regulators have actually decided

Three decisions exist and they point in different directions. The FDA continues to list Red 40 among the colour additives subject to batch certification. The European Union authorises E129 but attaches a mandatory sentence to every product containing it. California has legislated one narrow ban, restricted to public schools and not yet in force.

Two details in that ban get lost in the retelling. It covers schools, not shops, so the same product stays on the shelf across the road. And it names five other colours alongside Red 40, which makes it a decision about a category rather than about this dye in particular.

The attention and activity question

The EU labelling statement is the concrete regulatory fact underneath the attention question, and it is worth quoting rather than paraphrasing. Regulation (EC) No 1333/2008, Annex V requires products containing E129 to carry the words “may have an adverse effect on activity and attention in children”. The rule governs what a package prints.

A labelling requirement is a statement about what a package must say. It is not a finding that the additive does the thing the sentence describes — and the distinction is the entire reason the same product can carry that line in Europe and nothing at all in the United States.

That is why the identical formula reads differently on two continents. A drink made to one recipe carries the sentence on an EU label and no equivalent wording on a US one, and neither package is telling a lie about the other market’s science. They are complying with two different labelling regimes.

This page deliberately does not summarise the trial literature behind that regulation. Doing it honestly means naming each study, its sample size, its age range and its endpoints, and anything less turns a genuinely contested body of work into a slogan pointing whichever way the writer already leaned. What is quotable without that work is the regulation, and it is quoted above.

Worth saying plainly: no regulator anywhere publishes a ranked list of additives to avoid. The lists that circulate online are private compilations, they disagree with each other about which substances belong on them, and none of them carries the authority the format implies.

How Red 40 differs from additives that were withdrawn

Red 40 has not had an authorisation withdrawn in any major market. Two other entries in the same reference have, and reading them side by side shows what a withdrawal actually looks like on paper — an instrument, a decision date, and a compliance date after which the substance may no longer be used.

Red 3, the other synthetic red, is the sharpest contrast. The FDA revoked the food authorisation on 15 January 2025; the ban takes effect 15 January 2027 for food and 18 January 2028 for ingested drugs, under 90 FR 4628 (16 Jan 2025) and 21 CFR 74.303. That is a permission being taken away with a date attached to it.

The second contrast runs the other way. Titanium dioxide was removed from the EU list of permitted food additives by Regulation (EU) 2022/63, effective 7 February 2022, and remains permitted in the US at up to 1% by weight of the food — a split verdict written into two documents. Set beside those two, the Red 40 entry contains a labelling obligation and a school procurement rule. Nothing has been revoked. Being able to tell those three shapes of document apart is more durable than any verdict this page could hand you, because the documents change and the skill does not.

How to find Red 40 on a label and check the rest of it

Colour declarations sit near the end of an ingredient list, after the preservatives, and often after a phrase such as “contains less than 2% of”. Read that tail deliberately, because the front of the list is where the calories are and the back of the list is where the additives are.

    Read the last third first

    Colours are declared at the end of the list, frequently after a "contains less than 2%" phrase. Scanning the first six ingredients will miss every dye in the product.

    Look for all five names

    Red 40, FD&C Red No. 40, Red 40 Lake, Allura Red AC and E129 are the same colourant. A pack sold in two markets may print two different names for the same substance.

  3. Step 3

    Check for the lake form separately

    Coated sweets, tablets and icings often carry the lake rather than the soluble dye, or both. Searching only for the word "Red 40" catches the lake too, but searching for "Allura" does not.

  4. Step 4

    Then read the whole list

    One dye out of thirty names tells you very little on its own. What the rest of the list contains — the sweeteners, the emulsifiers, the refined oils — is the more informative question.

That last step is what the ultra-processed food checker is for. A regulatory status check answers one question — what has an authority formally decided about this substance, and in which document. It cannot tell you what a dye does inside a particular person, and it has nothing at all to say about how much of anything a specific diet should contain.

Works from a person rather than a document, can supervise an elimination trial, and can tell a food reaction apart from the several other things that produce the same symptoms.

Best for A diagnosed sensitivity, a child on a restricted diet, or any concern that has persisted long enough to be worth investigating properly.

Red 40 is not banned from general sale in either the United States or the European Union, where it is authorised as E129. The one ban written into law names schools. When is checking a single additive not enough
Checking one additive is the wrong approach when the question is really about a whole diet or a whole product. A single name says nothing about how often something is eaten, in what quantity, or what else is in the formula. Anyone dealing with a diagnosed reaction needs a clinician, not an ingredient lookup.
